By publishing through West Harbor Publishing LLC, Artist agrees to the following terms and conditions. Continued use of the platform constitutes ongoing acceptance of these terms.
1. Rights
Artist retains full ownership of all music and related content published through West Harbor Publishing. This agreement does not transfer, assign, or encumber any rights held by Artist. Artist may publish, sell, or distribute the same work through any other platform or publisher simultaneously without restriction.
2. Services
All artists on the West Harbor Publishing platform are provided a Store Page, hosted on Publisher’s platform, at a cost of $10 per month.
DNS configuration and subdomain setup, if applicable, are included in the monthly hosting fee.
Domain Name — Securing and maintaining a domain name is the sole responsibility of Artist. Publisher will assist with DNS configuration once the domain is in Artist’s possession.
Artists may request additional services such as a main website consisting of a Main Page, an About Page, and an optional Blog or Journal Page, hosted under the West Harbor Publishing platform. These will be quoted and agreed upon in writing prior to commencement, and may require an additional monthly fee.
3. Revenue Share
Publisher will retain 15% of net sales revenue on music sold through the West Harbor Publishing platform. This revenue share applies only to sales made directly through Publisher’s platform. Sales made through any other platform or channel are not subject to this agreement.
Publisher will pay Artist their share of net sales revenue on a biweekly basis, provided the balance due exceeds $15. Balances below $15 will carry over to the following pay period, to a maximum of 90 days. Any outstanding balance will be paid in full within 90 days regardless of amount. Payments will be made to the Artist’s account of choice.
Publisher will provide Artist with a sales report at the time of each biweekly payment, detailing units sold and revenue generated during that period.
4. Tax Documentation
Artist is required to provide a completed W-9 form before any sales are made through the Publisher’s platform.
5. Content Standards
West Harbor Publishing is a Christian-oriented operation. Published works are not required to be religious in nature or theme, and Artist is not required to share Publisher’s faith. However, Publisher will not publish works that are anti-Christian in orientation or intent.
Artist represents and warrants that all content submitted to Publisher is their own original work or that Artist has the legal right to distribute it, and that it does not infringe on any third party’s copyright, trademark, or other rights, and does not contain defamatory, unlawful, or otherwise legally actionable material. Artist assumes full responsibility for any legal claims arising from their content.
Publisher reserves the right to remove any content that violates these standards immediately and without notice.
6. AI Use
West Harbor Publishing welcomes music created with the assistance of artificial intelligence. Artists are strongly encouraged to disclose the nature and extent of any AI involvement in their work — for example, whether AI was used for lyrics, music, production, or some combination of these. A general description of AI involvement is appreciated and helps us represent your work accurately.
7. Termination
Either party may terminate this agreement at any time.
If Publisher initiates termination, Publisher will notify Artist in writing. Barring a violation of Content Standards outlined in Section 5 above, Artist’s content will remain on the platform for up to 30 days from the date notice is sent, giving Artist time to make alternative arrangements. Any outstanding balance owed to Artist will be paid in full within 90 days of termination.
If Artist initiates termination, Artist will remove their content within 30 days of giving notice. After 30 days, all remaining content will be removed by Publisher. Revenue collection and sharing will continue on any content that remains on the platform during the 30 day period. Any outstanding balance owed to Artist will be paid in full within 90 days of termination.
If Artist is found to be in violation of the content standards described in Section 5, Publisher may immediately remove any or all of Artist’s content without notice, and may terminate this agreement at Publisher’s discretion.
8. Miscellaneous
This agreement constitutes the entire understanding between Publisher and Artist regarding the subject matter herein. Any modifications must be made in writing and agreed to by both parties.
This agreement is governed by applicable law.
